Welcome to Flag & Freedom.

These Terms of Service (“Terms”) govern your access to and use of flagandfreedom.com (the “Site”) and any products, services, features, content, or purchases made through the Site.

Throughout these Terms, the terms “Flag & Freedom,” “we,” “us,” and “our” refer to Flag & Freedom. The terms “you” and “your” refer to any visitor, customer, or other user of the Site.

By visiting our Site, purchasing a product from us, creating an account, or otherwise using our services, you agree to be bound by these Terms and by any additional policies referenced within them.

Minor variations between photographs and the finished product are not necessarily considered defects.

Product availability is subject to change without notice.

We may discontinue any product at any time.

4. SIZING AND FIT

Sizing information and size charts are provided as guidance.

Actual measurements and fit can vary slightly between garments, manufacturing batches, colors, and styles.

Customers are responsible for reviewing the applicable sizing information before placing an order.

Our Return Policy governs whether products purchased in an incorrect size may be returned or exchanged.

5. PRICING

All prices displayed on the Site are listed in U.S. dollars unless otherwise stated.

Prices may change at any time without notice.

A price change will not normally affect an order that has already been accepted and paid for, except where there has been an obvious pricing or technical error.

Taxes, shipping charges, or other applicable fees may be added during checkout where required.

6. PROMOTIONS, DISCOUNTS AND SALES

From time to time, Flag & Freedom may offer promotional pricing, discount codes, automatic discounts, free shipping offers, limited-time sales, or other promotions.

Flag & Freedom is not responsible for delivery problems caused by inaccurate or incomplete information provided by the customer.

If you notice an error after placing an order, contact us as soon as possible.

We cannot guarantee that an order can be changed once processing or production has begun.

9. PAYMENT

Payment must be successfully authorized before an order can be processed.

Payment processing may be performed by Shopify Payments or other third-party payment providers made available through our checkout.

We do not directly control the services provided by third-party payment processors.

By submitting payment information, you represent that you are authorized to use the payment method provided.

10. SHIPPING AND DELIVERY

Shipping estimates are estimates and are not guaranteed delivery dates unless explicitly stated otherwise.

Delivery times can be affected by carriers, weather, holidays, high order volumes, incorrect addresses, transportation interruptions, customs processing, or other circumstances outside our reasonable control.

Our current shipping practices, shipping charges, free-shipping thresholds, and related information are described in our Shipping Policy, which forms part of these Terms.

Customers are responsible for providing an accurate and deliverable shipping address.

11. RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, and exchanges are governed by our Return and Refund Policy as published on the Site.

Customers should review that policy before completing a purchase.

Nothing in these Terms is intended to remove any consumer rights that cannot legally be waived under applicable law.

Where appropriate, we may work with the shipping carrier to investigate the delivery.

Nothing on the Site grants you ownership of Flag & Freedom intellectual property.

Flag & Freedom names, logos, branding, artwork, and other brand identifiers may constitute trademarks or other protected intellectual property.

We are not obligated to publish submitted content and may remove content that violates our policies.

Where liability cannot legally be excluded, our liability will be limited only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

23. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Flag & Freedom and its owners, employees, contractors, service providers, and affiliates from claims, losses, damages, liabilities, and reasonable expenses arising from:

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Flag & Freedom concerning your use of the Site and purchases through it.

30. GOVERNING LAW

These Terms and any transactions through the Site will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any dispute that is permitted or required to be brought before a court will be subject to the jurisdiction of the appropriate courts located in Texas, except where applicable law provides otherwise.
